5. Our lawful bases for processing

Depending on the circumstances and the applicable law, we may process your personal data on one or more of the following bases:

Legitimate interests. As a recruitment business, we have a legitimate interest in identifying potential candidates, maintaining professional relationships, matching candidates with opportunities, providing recruitment services and operating and developing our business.

Before relying on legitimate interests, we consider whether the processing is necessary and proportionate and whether your rights and interests override our interests.

Steps taken at your request before entering into a contract, or performance of a contract. This may apply where you ask us to represent you, apply for a particular role or enter into another contractual relationship with us.

Legal obligation. We may process information where necessary to comply with legal or regulatory requirements.

Consent. In limited circumstances, we may ask for your consent for a specific purpose. Where we rely on consent, you may withdraw it at any time.

Where we process special category personal data or criminal offence data, we will only do so where permitted by law and where any additional legal conditions and safeguards are satisfied.

6. Who we may share your personal data with

Where necessary for the purposes described in this Privacy Policy, we may share your personal data with:

  • prospective employers and clients with relevant vacancies;
  • hiring managers and other authorised individuals involved in a recruitment process;
  • recruitment partners, intermediaries and compliance partners involved in arranging or supporting a placement;
  • technology and service providers that support our business, including our recruitment CRM, email, cloud hosting and other business systems;
  • professional advisers such as accountants, lawyers and insurers;
  • organisations carrying out lawful background, reference, qualification or compliance checks where relevant to a role;
  • regulators, courts, law-enforcement bodies or other authorities where required by law; and
  • another organisation in connection with a genuine merger, acquisition, restructuring or sale of all or part of our business.

We expect service providers acting on our behalf to process personal data only for appropriate purposes and to apply suitable security and confidentiality measures.

We will not ordinarily send your CV or identifiable candidate profile to a prospective employer without first discussing the relevant opportunity with you.

7. International transfers

Foxmont Talent is based in the United Kingdom and recruits across the DACH region. As a result, your personal data may be shared with clients, recruitment partners or service providers located outside the country in which you are based.

Where an international transfer is subject to data protection restrictions, we will take appropriate steps required by applicable law. Depending on the destination and circumstances, these may include relying on an adequacy decision or regulation, appropriate contractual safeguards or another lawful transfer mechanism.

8. Technology, artificial intelligence and automated decision-making

We may use technology-assisted tools, including artificial intelligence, to support limited administrative and recruitment activities. These may include:

  • organising or summarising candidate information;
  • identifying information within CVs and professional profiles;
  • supporting searches for potentially relevant candidates;
  • drafting or improving communications; and
  • supporting other administrative recruitment tasks.

These tools support our work; they do not replace professional judgement.

Foxmont Talent does not make decisions that have legal or similarly significant effects on candidates based solely on automated processing. Human judgement and review remain part of our recruitment process.

If our use of artificial intelligence or automated processing materially changes, we will review our practices and update this Privacy Policy where appropriate.

9. How long we keep your personal data

We retain personal data only for as long as reasonably necessary for the purposes for which it was collected, including providing recruitment services, maintaining appropriate business records and complying with legal, regulatory, accounting and reporting obligations.

When deciding how long to retain personal data, we consider:

  • the nature of our relationship and our last meaningful contact with you;
  • whether your experience and career interests may remain relevant to future opportunities;
  • the amount, nature and sensitivity of the information;
  • the purposes for which the information is used;
  • legal, contractual and regulatory requirements;
  • limitation periods and the possibility of legal claims;
  • whether you have asked us to delete or restrict use of your information; and
  • whether continued retention remains necessary and proportionate.

We periodically review the personal data we hold and will delete, anonymise or otherwise securely dispose of information when it is no longer reasonably required.

You may ask us at any time to delete your personal data. We will consider and respond to the request in accordance with applicable law.

10. Data security

We take appropriate technical and organisational measures designed to protect personal data against accidental or unlawful loss, misuse, alteration, unauthorised access or disclosure.

Access to personal data is limited to those who have a legitimate need to use it. Service providers processing personal data on our behalf are expected to apply appropriate security and confidentiality measures.

No method of transmitting or storing information is completely secure, but we take reasonable steps appropriate to the nature of the information and the risks involved.

11. Your rights

Depending on the circumstances and applicable law, you may have the right to:

  • be informed about how your personal data is used;
  • request access to your personal data;
  • request correction of inaccurate or incomplete personal data;
  • request deletion of your personal data;
  • request restriction of processing;
  • object to certain processing;

12. Keeping your information accurate

Please let us know if your personal data changes or if you believe the information we hold about you is inaccurate.

We may also update professional information from appropriate sources where this is lawful and reasonably necessary to keep our records relevant and accurate.

13. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our services, technology, business practices or legal obligations.

The latest version will be published on our website with the date of the most recent update.
